We may also use information collected from you and information collected from your device to send you abandoned cart reminders if you added items to your shopping cart but did not complete check out.

DGW COLLECTIBLES & ESTATES:
TERMS & CONDITIONS OF SALE

Effective October 2025
These Terms & Conditions (“Terms”) govern all auctions conducted by DGW Collectibles Inc. d/b/a DGW Collectibles & Estates (“DGW,” “we,” “our,” or “us”). By registering to bid, placing a bid, or purchasing any lot, you agree to be bound by these Terms in full.

1. GENERAL CONDITIONS

All property is sold AS IS, WHERE IS, and WITH ALL FAULTS.
There are no returns, refunds, exchanges, or credits under any circumstances once bidding has concluded, except as provided in Section 2 (Authenticity & Counterfeits).
All sales are final and legally binding upon the fall of the auctioneer’s hammer or the close of online bidding.

Participation in any DGW auction constitutes the bidder’s acknowledgment that they have read, understood, and accepted these Terms.

2. AUTHENTICITY & COUNTERFEITS

DGW makes every effort to accurately describe items offered for sale. However, no statement by DGW—oral, written, or online—shall be deemed a warranty or representation of fact. All written and verbal descriptions reflect DGW’s good-faith opinions only.

Limited Exception:
If an item that was sold by DGW is later proven by a qualified and widely recognized authority (e.g., PSA, PCGS, GIA, AGS, or comparable) to be counterfeit, DGW Collectibles Inc. will issue a refund of the hammer price and buyer’s premium upon receipt and verification of the disputed item in its original, unaltered condition within 60 days of buyer’s receipt.
This exception does not apply to differences in grading opinions, condition disputes, or market value discrepancies.

3. BIDDING & BUYER RESPONSIBILITY

• Bidders are responsible for examining, researching, and evaluating all items prior to bidding.

• Condition reports, if provided, are informational only and may not be comprehensive.

• All photos form part of the description.

• By bidding, you signify that you have viewed all available photos and read the item description in full.

DGW Collectibles Inc. reserves the right to:

• Reject any bid or bidder at its sole discretion.

• Combine, divide, or withdraw lots prior to sale.

• Resolve any dispute between bidders; DGW’s decision shall be final.

4. PRICING & MARKET VALUE

Auction results are determined exclusively by competitive bidding. Final prices may exceed or fall below market or appraised value. By bidding, you acknowledge that you have independently assessed each item’s value and agree not to contest or seek reimbursement based on later appraisals, resale results, or perceived overpayment.

5. PAYMENT TERMS

• Payment is due within 24 hours of sale close.

• The credit card on file will be automatically charged for the purchase total.

• Failure to remit payment within 24 hours may result in bid cancellation and permanent revocation of bidding privileges.

• DGW reserves the right to require payment via certified funds or wire transfer for high-value transactions or at its discretion.

6. SHIPPING POLICY

All items are shipped fully insured based on the hammer price of each lot.
Shipping fees are billed separately and do not appear on the DGW auction invoice.

• For invoices over $100, additional insurance coverage is automatically included.

• The shipping and insurance fee will be charged to the card on file within 24–48 hours of successful payment for the auction invoice.

• If the card on file is declined, DGW will email a separate shipping invoice that must be paid within seven (7) days.
  Failure to pay within that period constitutes forfeiture (see Section 7).

Address Confirmation:
If you are a new customer or your shipping address has changed, you must email DGWCOLLECTIBLES@GMAIL.COM within 24 hours of receiving your winning invoice.
Include:
• Your full name as it appears on your invoice
• Your current shipping address (if different from Auction Ninja record)

If no update is received, items will ship to the address on file.
No alternate carriers or pickup arrangements are available unless explicitly stated.

7. FORFEITURE POLICY

Buyers must complete all required payment and shipping steps within seven (7) days of auction close.
Failure to do so will result in forfeiture of all won items, and the bidder will not be reimbursed, refunded, or credited by DGW Collectibles Inc. DGW may resell forfeited items without notice to the original bidder.

8. SHIPPING CLAIMS & LIABILITY

DGW Collectibles Inc. is not responsible for loss, damage, or delay once an item has been delivered to the carrier.
All shipments include tracking and insurance.
Claims for damage or loss must be reported to DGW within 7 days of product being marked delivered or after anticipated delivery date if it has not arrived. DGW will assist with insurance claim and all documentation but assumes no financial liability beyond the insurance coverage purchased.

9. TAXES

All applicable sales tax will be collected as required by law unless the buyer provides a valid resale or exemption certificate prior to invoicing.

10. BUYER’S PREMIUM & FEES

A buyer’s premium, as stated on the auction platform, will be added to the hammer price of all lots and forms part of the total purchase price due.

11. DEFAULT & COLLECTION

If any bidder fails to comply with these Terms, DGW Collectibles, Inc. may, in addition to other remedies available by law, retain all payments made and resell the property without notice. The defaulting bidder shall be liable for any deficiency, collection costs, attorney’s fees, and associated expenses.

12. GOVERNING LAW & JURISDICTION

These Terms constitute a binding agreement between the bidder and DGW Collectibles Inc. All disputes shall be governed by and construed in accordance with the laws of the State of New York. By participating in any DGW auction, bidders irrevocably consent to the exclusive jurisdiction of the courts of Dutchess County, New York.

13. LIMITATION OF LIABILITY

In no event shall DGW Collectibles Inc., its owners, employees, or agents be liable for any indirect, incidental, consequential, or punitive damages arising from participation in the auction, purchase, or use of any item.

14. PRIVACY NOTICE

Bidder information is collected for legitimate business purposes including registration, invoicing, and shipping. DGW Collectibles Inc. does not sell or share personal information except as necessary to complete transactions or as required by law.

MOBILE MESSAGING TERMS AND CONDITIONS

DGW Collectibles, Inc. (“[DGW Collectibles, Inc.”, “we”, or “us”) operates a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (these “Mobile Messaging Terms”). The Program and our collection and use of your personal information is also subject to our Privacy Policy at https://www.auctionninja.com/dgw-collectibles/ --> “MORE INFO”. By enrolling, signing up, or otherwise agreeing to participate in the Program, you accept and agree to these Mobile Messaging Terms and our Privacy Policy.

1.     Program Description: We may send promotional and transactional mobile messages in various formats through the Program. Promotional messages advertise and promote our products and services and may include promotions, auction opening or closing messages, specials, or other marketing offers. Transactional messages relate to an existing or ongoing transaction and may include [order notifications and updates and other transaction-related information. Mobile messages may be sent using an automated technology, including an autodialer, automated system, or automatic telephone dialing system. Message frequency will vary but will not exceed 4 messages per month. You agree that we, our affiliates, and any third-party service providers may send you messages regarding the foregoing topics or any topic and that such messages and/or calls may be made or placed using different telephone numbers or short codes. We do not charge for mobile messages sent through the Program but you are responsible for any message and data rates imposed by your mobile provider, as standard data and message rates may apply for short message service and multimedia message alerts.

2.     User Opt-In: By providing your mobile phone number to us, you are voluntarily opting in to the Program and you agree to receive recurring mobile messages from us at the mobile

phone number associated with your opt-in, even if such number is registered on any state or federal “Do Not Call” list. You agree that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at dgwcollectibles@gmail.com. Your participation in the Program is not required to make any purchase from us and your participation in the Program is completely voluntary.

3.     User Opt-Out and Support: You may opt-out of the Program at any time. If you wish to opt-out of the Program and stop receiving mobile messages from us, or you no longer agree to these Mobile Messaging Terms, reply STOP, QUIT, CANCEL, OPT-OUT, and/or UNSUBSCRIBE to any mobile message from us. You may continue to receive text messages for a short period while we process your request and you may receive a one-time opt-out confirmation message. You understand and agree that the foregoing is the only reasonable method of opting out. If you want to join the Program again, just sign up as you did the first time, and we will start sending messages to you again. For support, reply HELP to any mobile message from us.

Our mobile messaging platform may not recognize requests that modify the foregoing commands, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these Mobile Messaging Terms. We may also change the telephone number or short code we use to operate the Program and we will notify you of any such change. You acknowledge that any requests sent to a telephone number or short code that has been changed may not be received by us and we will not be responsible for failing to honor a request sent to a telephone number or short code that has been changed.

4.     Disclaimer of Warranty and Liability: The Program is offered on an “as-is” basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program.

5.     Modifications: We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Mobile Messaging Terms at any time. Any such modification will take effect when it is posted to our website. You agree to review these Mobile Messaging Terms periodically to ensure that you are aware of any modifications. Your continued participation in the Program will constitute your acceptance of those modifications.
