MEMBERSHIP ELIGIBILITY This site is available to members 18 years of age and older, and who have not been suspended or removed by Dude's Auction House LLC for any reason. By becoming a member you represent that you are of legal age. As a member, you agree to provide true & accurate, current & complete information about yourself in the site's registration forms. In addition, as a member, you agree & acknowledge that you will maintain valid credit card information within your membership profile, as long as you maintain an account with Dude's Auction House LLC.
BUYER'S CONTRACT
Bids placed on Dude's Auction House LLC website are a binding contract, and you are responsible for paying full amounts due to Dude's Auction House LLC, including hammer price, bidder's premium of 12%, and applicable sales tax. Please do NOT bid if you are unable to pay and take possession of the won items in the SPECIFIED TIME PERIODS for each auction. Any won items that remain unpaid for 24 hours of auction close are eligible for sale to under-bidders. ALL SALES ARE FINAL. NO RETURNS, CREDITS, OR EXCHANGES.
ITEM DESCRIPTION Please read the entire item description. We do our best to provide detailed descriptions: listing damage, repairs, or restorations, & pictures of the items so that you know exactly what you are buying. The absence of a listed condition must not be taken to imply that the lot is in perfect condition. Many items sold are vintage/ antique, or used and will have expected signs of wear that are consistent with age. We do not officially appraise or authenticate items, or provide warranties unless it is stated in the item description. If an item has a COA we will photograph with the item. We reserve the right to correct any errors, inaccuracies, or omissions, to change or update the information, or cancel any orders in the related website at any time. All items are sold "as is, where-is". Bidding on an item is the acceptance of these terms. ALL SALES ARE FINAL. NO RETURNS, CREDITS, OR EXCHANGES.
BUYER'S PREMIUM & SALES TAX
Before placing a bid you must register through the Auction Ninja platform. The buyer agrees to the terms & conditions of Auction Ninja, as well as Dude's Auction House LLC. Once a bid is placed it cannot be retracted. A 12% buyer's premium and applicable tax will be added to all winning bids.
All sales are subject to appropriate sales tax laws. Tax exempt buyers must provide the appropriate state sales tax exemption certificate prior to the end of the sale. Upon receipt of such information by Dude's Auction House LLC, your future purchases will not be taxed. Tax resale forms can be submitted in your membership profile. Your profile name & address must be the same as your resale certificate.
RETENTION OF CREDIT CARD By providing your credit card information to Dude's Auction House LLC, you authorize Dude's Auction House LLC to charge your credit card for the purchase amount of any successful bid, plus the buyer's premium of 12%, and any applicable taxes. Your card will be charged within 24 hours of auction end. Failure to keep valid credit card information on file will result in termination of your site use. To initiate your ability to bid with Dude's Auction House LLC, an initial $1.00 pre authorization transaction will appear on your statement. This pending transaction will not settle and will drop off after 5-7 business days. You certify that you are an authorized user of this credit card, and that you will not dispute the purchase payments with your credit card company, provided the transactions correspond to the terms indicated in this authorization outline. For security purposes, Dude's Auction House LLC does not store your credit card information.
UNDERSTANDING "SOFT CLOSE"
Our platform features extended bidding, AKA "soft closing". The system will automatically extend the closing time of a lot when a bid is placed within the last five minutes of its scheduled closing. This may occur multiple times on any given lot depending on the bidder interest. Once all interest and bidding in a lot ceases, the clock will run out, and the lot will close. This is the fairest way to give all bidders an opportunity to increase their bids if they wish to do so. This also mimics a live, in person auction. *MAKE SURE TO DOUBLE CHECK YOUR EMAIL TO CONFIRM A WINNING BID*
WINNING BIDS! Within two hours of auction closing, your credit card on file will be charged for the entire amount due (hammer price, buyer's premium of 12%, & applicable sales tax) The charges will not be processed until the entire auction closes. You will receive a winning bidder email which will contain your invoice, a list of won items, and details for picking up. PICKING UP ITEMS Winning bidders MUST pick up their items at the designated sale location within the assigned "pick up" time frame, as stated in the sale details page. If after winning an item you determine that you are unable to pick up your items during the scheduled removal time & dates, YOU MUST contact Dude's Auction House LLC within 24 HOURS prior to the pick-up date. We will determine if alternate arrangements can be made. These arrangements will be at the sole discretion of Dude's Auction House LLC. Winning bidders must bring a copy of their paid invoice in order to collect their items. If your purchased item sold for more than $500 please bring a valid ID for verification. Winning bidder MUST bring assistance to move & load their won items. All people picking up items assumes any & all responsibility for damage or injury that should take place once they are on the property.
FORFEITURE OF ITEMS Any paid or unpaid items not claimed (abandoned) during the assigned "pick up" time frame, in accordance with the site's terms & conditions, will be FORFEITED by you, NO REFUNDS, CREDITS, OR EXCHANGES. Dude's Auction House LLC at it's sole discretion will re-offer the items or donate them to a charity of choice. Dude's Auction House LLC reserves the right to report your account to collections for the total of the unpaid original invoice amount. Your membership with Dude's Auction House LLC will be revoked unless past due invoices and any additional charges are paid in full.
SERVER & SOFTWARE TECHNICAL ISSUES
In the event that there are technical difficulties related to the server, software, or any other online auction-related technologies, Dude's Auction House LLC reserves the right to extend bidding, continue the bidding, or close the bidding of the affected auction. Neither the company providing the software, nor Dude's Auction House LLC shall be held responsible for a missed bid, or the failure of the software to function properly for any reason.
