A Note to Our Customers in Regards to Pick Up: Bidding at Auction Ninja sales pick up times are very critical, as these sales need to be closed as soon as possible as we need to exit the property once the final pick up date is complete as we are dealing with real estate closings, etc. Our terms do offer alternative pick-ups for a fee to transport back to our Amesbury Gallery. The sales conducted at our warehouse locations are typically the same as these facilities are not staffed full time and items need to be cleared quickly as we move in inventory for the next online sale. We truly appreciate your business and try to make pick up as convenient as possible, but time is of the essence with these sales. John and Staff
ACCEPTANCE of TERMS: By registering to participate in a JMA auction thru AUCTION NINJA, you fully understand and expressly agree to the following terms and conditions, along with the agreement to be so bound. If a purchaser breaches any of these Terms of Sale, including the obligation to pay for purchased items, JMA may seek all remedies under the law including canceling the sale and reoffering the property without reserve. The rights and obligations of the parties shall be governed by the laws of the state of Massachusetts.
REGISTRATION: Registration is done thru the AUCTION NINJA platform. Registering to bid, Buyer agrees to the terms and conditions of Auction Ninja and JMA.
RESALE CERTIFICATES: Buyers must register thru their Auction Ninja account page to be approved for tax exemption. A copy of your current certificate must be uploaded to their site for approval. Buyers must do this 48 hrs prior to bidding. Once your account is charged no refund will be given on that sale. It is important you register your certificates when you sign up to Ninja.
PAYMENT: Payment is due upon receipt of invoice and will be charged to your credit card on file. Any other forms of payment must be approved by the office. If you are a dealer, please upload your tax exempt certificate 48 hours prior to bidding for approval by Auction Ninja. If you do not upload your form within this time frame tax will be charged. If you do not have a valid tax id you will be charged tax. In regards to large dollar amount purchases over $2,000, precious metals, jewelry, etc we reserve the right to require certified bank checks and for security purposes, we may ask you to provide additional information to confirm your identity. This may include verification of your credit card details, such as the name on the card, the last four digits, or a copy of a valid photo ID matching the name on the credit card. Please ensure any sensitive information is transmitted securely. NO REFUNDS FOR ANY REASON ALL SALES ARE FINAL.
TERMS: All sales are FINAL, NO CREDITS or RETURNS and are SOLD AS IS, WHERE IS, WITH ALL FAULTS. Bidders are strongly encouraged to ask any questions prior to bidding. Please refer to photos as part of the description and or condition. JMA will do its best to list any damage, repairs or restorations, the absence of these descriptions or conditions must not be taken to imply that the lot is in perfect condition. Remember you are purchasing antique, secondary market, vintage or used items, expect signs of wear consistent with age. If you have any questions, please text the auction manager. Do not bid if you have any doubts about the items. Once you have picked up your item, there are no refunds for any reason. Any questions must be addressed at pick up.
BUYERS PREMIUM: A buyer’s premium will be applied to the purchase price of all items. Please view each sale for specific Buyers Premium.
SPECIAL PICK UP INSTRUCTIONS: Winning bidders must provide boxes and paper. Winning bidders are responsible for removal and loading of all items. Smaller items will be available for curbside pickup. A representative will be there to assist but the winning bidder assumes any and all responsibility for any damage or injury that should take place once they are on the property.
PICK UP LOCATION and TIME: WILL BE PROVIDED WITH YOUR INVOICE ALONG WITH ANY SPECIAL INSTRUCTION. ITEMS NOT PICKED UP DURING ALLOTTED TIME BUYER WAIVES THEIR RIGHT TO REFUND AND/OR CHARGEBACK DISPUTE DUE TO YOUR FAILURE TO PICK-UP YOUR AUCTION WINNINGS DURING THE SCHEDULED PICK-UP DATE(S) AND TIME(S). NO EXCEPTIONS, UNLESS PRIOR ARRANGEMENTS HAVE BEEN MADE WITH THE AUCTION HOUSE. Unless prior acceptable pick up or shipping arrangements have been agreed upon prior to purchase, a storage charge of up to $25 a day could be applied to any item left on premise after agreed upon date. Items not picked up may also be subject to a disposal fee charge, depending on size and type of item. If you are purchasing lots with multiple pieces, please make sure to account for all pieces prior to leaving the auction site. Once you leave the location, JMA is not responsible for any items left behind.
FORFEITED/UNPAID ITEMS: Any item(s) that is not paid for and / or not picked up during the required pick up time provided on our site will be forfeited by you with NO REFUNDS FOR ANY REASON. ALL ITEMS ARE SOLD AS, WHERE IS, WITH ALL FAULTS. JMA will reserve the right to reoffer or donate. JMA reserves the right to report your account to collections for the combined total of the original invoice amount and any moving or disposal charges. Bidding privileges will be suspended for any non-paying bidder.
TRANSPORT (ALTERNATIVE PICK UP): As a special service for the convenience of our valued customers: Anyone who would like to pick up their purchases in Amesbury, MA we will offer to transfer your purchases to our facility in Amesbury for a nominal fee starting at $25 per item to be capped at $100.00. NOTE: EXCLUSIONS APPLY, LARGE OR UNUSUAL ITEMS/LOTS WILL BE ASSESSED A SEPARATE FEE FOR TRANSPORT. ANY ITEM(S) TRANSPORTED BACK TO OUR AMESBURY FACILITY MUST BE PICKED UP WITHIN 5 DAYS OR WILL BE CONSIDERED ABANDONED.
ITEMS TRANSPORTED OR LEFT AT OUR GALLERY MUST BE REMOVED WITHIN 10 DAYS OF THE END OF THE AUCTION. Items are stored at the risk of the Purchaser. A 24 hour notice is required for any items that are to be picked up. A storage fee of $10.00 per day WILL be assessed per item if not removed within the requested time, regardless of size and value of the lot(s). Unless prior arrangements have been made and agreed to. Any item left in our gallery for more than one year, without making arrangements, will be considered abandoned. The item(s) will be sold, storage fees will be deducted and a check for the balance will be sent to the address we have on file. WE ARE NOT RESPONSIBLE FOR ANY DAMAGE OR LOSS .
SHIPPING OUT OF STATE: Small items will be given to a local shipper which will be on your invoice. Buyer pays all costs associated with shipping. We highly recommend you reach out for a quote prior to bidding. If you would like to use a shipper of your choice, please call our gallery to discuss prior to bidding.
