1. USE OF SITE/BUYERS CONTRACT
All bidders authorize Simmons Auction House via Clearing House Estate Sales to charge the credit or debit card you have entered on this site for ...view morethe hammer price of an item which you were the high bidder plus the buyer's premium and all applicable sales tax. shipping will be handled separately. Bids placed on the CHES website are a binding contract and you are responsible for paying all amounts due to SAH via CHES including sale price, buyer's premium and all applicable taxes. 2. ITEM DESCRIPTIONS
All items are sold as-is. While SAH will do its best to list any damage, repairs or restorations, the absence of these descriptions or conditions must not be taken to imply that the lot is in perfect condition. Most of the items SAH via CHES sells are antique, vintage or used. You should expect signs of wear consistent with age. SAH on special items will offer preview inspections by appointment. 3. BUYER’S PREMIUM/TAX
A buyer’s premium of 20% will be added to the hammer price in all auctions and will be charged along with the hammer prices and applicable sales tax to the credit or debit card you have on file with CHES within 24 hours of the auction end. Any problems... Frank Simmons 732.672.5687
All sales are subject to appropriate sales tax laws. Tax exempt buyers must provide tax exemption certificate prior to the end of the sale.
4. PICK-UP
Winning buyers will receive address and instruction via E-mail LET US KNOW IF YOU DO NOT RECEIVE THIS- PLEASE MAKE SURE YOU HAVE SELECTED IN YOUR DASHBOARD TO RECEIVE AUCTION WIN E-MAIL VIA TEXT OR E-MAIL. Winning buyers must pick up their items at the designated sale location within the assigned time frame as stated in the sale details page. If you are unable to pick up your items during the scheduled P/up time and dates, contact SAH within 24 hours (PLEASE) prior of the pick-up date and we will determine if alternate arrangements can be made. These arrangements will be at the sole discretion of SAH and will be subject to transport, labor and/or storage fees. SAH will work with buyers who work with us. Frank Simmons 732.672.5687
5. SHIPPING
We will ship any item at the buyers cost upon request. Items marked Local Pick-Up in the title/description cannot be shipped. There are some small shippable items that may have high cost based on weight and or odd size. We require all bidders to use common sense when bidding. All shipping cost need payment within 48 hours of receiving documented cost. This includes shipping cost invoice delivered via, texts, e-mail, and or verbal message. SAH will "attempt" to provide the buyer with the best possible means of shipment. The word "attempt" in the previous statement means SAH may at times charge a higher shipping price above minimum shipping cost to provide shipping continuity. SAH will insure shipped items based on final hammer price. If more insurance is needed this will be added to winning bidders invoice. SAH will professionally pack your items. SAH is not responsible for lost or broken items in the shipping process. SAH charges a handling fee of 7.00 (seven) dollars for total shipment regardless of amount of packages. Please allow up to 2 (two) weeks for shipments to be sent. When applicable tracking will be provided. The above rules are necessary but if you move, or prefer an alternate shipping address just call Frank Simmons 732.672.5687
6. FORFEITURE OF ITEMS
Any items not paid and / or not picked up during the specified pick up time in accordance with Terms & Conditions will be forfeited by the winning bidder. SAH has sole discretion to reoffer. SAH requests all shipping invoices be paid within 48 hours of receipt. Failure to pay shipping cost within the above stated time can at SAH discretion result in forfeiture of the ability to ship, extra handling charge, storage fee, and or forfeiture of winning items. 7. PROHIBITED
THIS IS IMPORTANT!!! Additionally SAH is run from a private residence. All potential bidder and/or winning bidder are prohibited from entering the grounds and said residence any time other than specified pick up time and/or special appointment set by SAH.
