1. Introduction

Welcome to Warren Exchange. By browsing, bidding, or purchasing from Warren Exchange (via AuctionNinja or any other platform), you (“Buyer” or “Bidder”) agree to be bound by these Terms & Conditions. If you do not agree, do not bid or purchase.

2. Eligibility

• Only persons 18 years of age or older may bid or purchase.

• By bidding or buying, you represent that you have capacity to enter into a legally binding contract, and that the information you provide (name, address, email, payment details) is accurate and complete.

3. Auction / Bidding Terms

• All items are sold “AS-IS, WHERE-IS”, with no warranties or guarantees beyond what is expressly provided. It is the buyer’s responsibility to perform due diligence (examine photos/descriptions, ask questions, request condition reports) before placing a bid. 

• Once the auction ends and the hammer falls, the highest bid is a binding contract — you are legally committed to purchase the item.

• Bids may not be retracted. Buyers who win must complete payment and accept the item under the stated terms.  Failure to pay for the lots won within 2 days may result in forfeiture of the lot and loss of bidding privileges.

4. Pricing, Fees & Taxes

• The buyer agrees to pay the hammer price, plus any applicable buyer’s premium (if charged), shipping/handling (if applicable), and applicable taxes.

• Because coins are sales-tax-exempt in Rhode Island, purchases shipped  or picked up in RI will be tax-free. For out-of-state shipping or shipping to a state that taxes coins, buyer is responsible for any applicable sales/use tax.

• Shipping is charged on a separate invoice. Failure to pay shipping within 2 days may result in forfeiture of the lot and loss of bidding privileges.

5. Payment Methods

• Payment accepted via: credit card or paypal

• For card payments: by submitting payment information you certify you are an authorized user of the card.

• If shipping is chosen: items will not be released until payment clears in full.

6. Shipping / Pickup / Risk of Loss

• For shipped items: Buyer is responsible for providing a correct and complete shipping address.  Shipping is paid by separate invoice.  We will send you an invoice, you can pay by credit card or we can bill you through paypal.

• Warren Exchange is not liable for loss, delay, or damage once items are shipped (unless insurance is elected and paid for).

• For in-person pickup: Buyer must pick up items within  14 days of auction close, or forfeit the lot, unless other arrangements are made in writing.

• Title and risk of loss pass to Buyer upon delivery (or upon pickup), even if the item is lost or damaged afterward.

7. Authenticity & Returns / Disputes

• Coins, bullion, and other items are represented to the best of Warren Exchange’s knowledge. All bullion is sigma verified to validate precious metal content.  All items remain subject to Buyer’s own inspection and judgment.

• Because items are sold “as-is,” no returns or refunds will be accepted for buyer’s remorse (e.g. change of mind, market fluctuations, aesthetic preference).

• If there is a legitimate dispute (e.g. item is materially misdescribed, counterfeit, stolen, or prohibited), Buyer must notify Warren Exchange within 5 days of receipt, provide clear evidence, and allow for a resolution (refund of purchase price or partial refund, replacement, etc.).

8. Prohibited Items & Compliance with Law

• Warren Exchange prohibits the sale of stolen or illegally obtained goods, or items prohibited by law. 

• By listing and selling through AuctionNinja, Warren Exchange agrees to comply with applicable state and federal laws — including laws related to numismatic items, bullion, sales tax, and commerce.

9. Limitation of Liability

• To the maximum extent permitted by law, Warren Exchange disclaims liability for any direct or indirect loss, damages, or claims arising from auction participation, bidding, purchase, shipping, or resale.

• Buyer assumes all risk related to the value of coins/bullion, market fluctuations, authenticity, transport, and handling.

10. Governing Law & Dispute Resolution

• These Terms shall be governed by the laws of the State of Rhode Island.

• Any dispute related to the auction, sale, or these Terms shall be resolved in the courts of Rhode Island (or through arbitration if you choose, though no arbitration is required).

11. Modification of Terms

• Warren Exchange reserves the right to modify or update these Terms at any time. Updated Terms apply to all auctions beginning after the new Effective Date. It is Buyer’s responsibility to review Terms before bidding.
