TERMS AND CONDITIONS OF AUCTION:

By bidding, the buyer agrees to all the terms defined below without exception. Failure to review these terms does not allow for an exemption to the conditions set forth.

Please use pictures of the items as descriptions and all items are “AS IS” - make sure to view all photos. Descriptions are to the best of our understanding, and NOT TO BE USED AS THE ABSOLUTE ITEM IDENTIFICATION.

All items that are powered have been tested and are in working condition unless otherwise noted in the item description.

Any questions concerning an item please contact us through the Auction Ninja system, or via email at reservoirauctions@gmail.com. We do our best to respond to messages in a timely manner, but it is not guaranteed.  

TERMS AND CONDITIONS OF AUCTION PICKUP:

Any buyers who purchase large or heavy items (requiring more than one person) agree to bring sufficient help to remove the item(s) safely. Our staff is not able to assist with moving or loading your items. 

Buyers agree to the defined pickup times listed on the event page - it is the BUYER'S RESPONSIBILITY to ensure they are available to attend the specific day and time listed. It is not the responsibility of Reservoir Auctions LLC to notify or remind buyers of their responsibility to remove their winning bid items from the auction pickup event. 

At each pickup event, it is the  BUYER'S RESPONSIBILITY to verify their order is both complete, accurate and satisfactory by referencing the invoice provided by Reservoir Auctions LLC.

Once a Buyer leaves the event, there are no options for returns or refunds (including partial refund) for any reason. All Buyers must sign the provided invoice for our records relating to any order to prevent any "friendly fraud" instances of chargebacks for items related to the auction.

Buyer understands that by placing a bid on Auction Ninja for any of our events, they are both affirming their ability to remove any items won on the defined pickup day/date and that any items that remain uncollected for any reason are returned to the Estate with no refund to the buyer. If we have an invoice on file with your account, this means you won items and are obligated to pay our company for the total due regardless whether you pick them up or leave them abandoned.

It is the responsibility of the buyer to bring packing material or other supplies to ensure their items are able to be transported safely - this is especially relevant to large orders or fragile items. We will have the items ready for pickup but it is the Buyer’s responsibility to  inspect the items and pack them for transport. 

By bidding, buyers commit to collect items during specified pickup times. Uncollected items are forfeited without refund and returned to the Estate. Buyers must pay for all won items, regardless of pickup. If an invoice exists, full payment is required even if items are not collected.

To summarize: 

By bidding, Buyers commit to:

1. Collect items during specified pickup time(s) as stated on the event page.
2. Forfeit uncollected items without refund.
3. Pay for all won items, regardless of pickup.

Failure to collect items results in:

• No refund.
• Ownership of items is returned to the Estate at the discretion of Reservoir Auctions LLC.
• Full payment is still required if the invoice exists.
• No alternate pickup time available.

Buyer agrees that the order delivery is complete and satisfactory by removing the items from the auction pickup. No refunds will be given once the buyer leaves with their items since we are unable to determine with 100% certainty who is at fault for any issue in question.

Reservoir Auctions LLC does not load or transport any items under any circumstances. Bring all necessary tools and labor you will need to pick up your items. Reservoir Auctions LLC will not be held liable for damage to item or vehicle, and is required to refuse loading items into Buyer’s vehicle. The Buyer is responsible for safe removal and transportation of their item(s.)

Buyers are not to enter the home or facilities, so no damage is caused to the home or facility during pickup. Items are brought outside for inspection and satisfactory removal.

Pickup of items is available ONLY on advertised days during advertised times. Please understand that we have limited time for access to the property. Failure to pick up purchased items during advertised pickup times will result in forfeiture of the purchased item(s.)

No early bird arrivals will be allowed - no exceptions.

ALL SALES ARE FINAL. NO RETURNS, NO CREDIT, OR EXCHANGES.

Pickup of items is available ONLY on advertised days during advertised times. Please understand that we have limited time for access to the property. Failure to pick up purchased items during advertised pickup times will result in forfeiture of the purchased item(s)
