We collect the following information (including, but not limited to) when you use the Site:
The Site is not directed to children under the age of 18. We do not knowingly collect personal information from children under the age of 18. If you are a parent or guardian and you believe that your child has provided us with personal information, please contact us. We will take steps to remove the information.

Before you bid, please read these Terms & Conditions. By registering or placing a bid, you agree to all of the following:
1. Who Can Bid
•You must be 18 or older to bid.
•You must register to bid.
2. Registration
•The process of registration resulting in a successful account creation provides you with a bidder number.
•Registration requires your submission of personal information that may include your name, address, phone, email, and a valid credit card.
•Anything bid under your registered account is your responsibility — keep your account information safe.
•All sales are final – there are no refunds or exchanges.
3. How Auctions Work
•Items may sell with either a reserve or no reserve.
•A winning bid is a binding contract to purchase.
•The auctioneer sets increments, controls bidding, and may reject bids.
4. Buyer’s Premium & Tax
•A Buyer’s Premium of 10% is added to all purchases. This 10% fee covers fees involved in hosting an auction and processing payments.
•Sales tax (if applicable) is charged on both your bid price and the premium.
5. Auction Closing
•Closing times are approximate; we may extend or shorten at our discretion.
•Place bids early—don’t wait until the last second.
•All times are in Mountain Standard Time (MST).
5. Payments
•Accepted payments: Credit Card (all major U.S. cards).
•If you win, the card on file may be charged.
•Payment is due at time of Auction Close.
•Failure to pay may result in relisting, fees, or loss of bidding privileges.
•SpicyAuctions.com will have the right to charge your card on file at any time to try to recoup the money that is owed.
•If it goes past a week from the auction you may be charged and forfeited your items.
•Payment Defaults & Declined Cards
•If your credit card is declined, a $10 decline fee will be added to your invoice each time the card fails.
•If payment is not made within 24 hours, your items may be placed in storage up to a week until paid.
•After a week your item may forfeited and automatically relisted.
•If items are relisted due to non-payment, you will be charged for the full price of the item plus any fees.
•SpicyAuctions.com reserves the right to charge your registered credit card at any time to recover any unpaid balances, fees, or costs owed.
•Unpaid items may also result in suspension or a permanent ban from future auctions.
6. Pickup & Removal
•Local pickup is available during the scheduled date and time only.
•To cover labor and overhead, a $1.00 handling fee per lot is added to all lots.
•Example: If you win 5 lots, your invoice will include an extra $5.00 (5 × $1.00).
•Bring your own help and equipment. Staff does not load items.
•Any damage during removal is your responsibility.
•Items not picked up on time may be considered abandoned and resold or disposed of.
7. Storage Policy
•If you can’t pick up on time, we’ll hold items until the next business day for free.
•After that: $5 per item per day storage fee.
•After 7 days, unclaimed items are considered forfeited and become property of SpicyAuctions.com.
8. Condition of Items
•The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging.
•Please review all images for any lot prior to bidding.
•By placing a bid, you signify that you have examined the items as fully as you desire or that you have chosen not to examine them.
•If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question.
•Bidding on these items is acceptance of these terms.
•All items are sold “AS-IS, WHERE-IS, WITH ALL FAULTS.”
•No guarantees, warranties, returns, or refunds.
9. Titles & Vehicles
•Titles are transferred between buyer and seller at a notary.
•SpicyAuctions.com is not responsible for title transfer issues.
10. Shipping (if available/applicable)
•Items/Lots in an auction may or may not be offered for shipping. Some items may be local pickup only. Please be aware of shipping status of a lot before you bid on any item.
•Shipping is handled in-house.
•Shipping is calculated and processed after Auction Close.
•Lots will be combined for a single shipment cost.
•Buyer will be invoiced for shipping after Auction Close and payment for items has been successfully completed.
•Shipping Fees will be applied to cover labor, supplies, overhead and the actual carrier shipping charges:
•$1.00 handling fee per lot (same as local pickup).
•$1.00 packing fee per lot, capped at $10 per box. (Handle fee still applies)
•Buyer pays actual postage.
•Shipping Insurance may be available available at buyer’s request.
•Shipping insurance is paid by buyer.
•SpicyAuctions.com is not responsible for any damage or lost items once it is in the shippers hands. We will do everything in our power to help you with an insurance claim if needed.
11. Rules & Responsibilities
•You own your items the moment bidding closes.
•No claims once items leave the premises.
•Sales tax applies unless you file a valid exemption before bidding.
12. Legal Notes
•All disputes fall under Colorado law, Boulder County courts.
•Auctioneers act as agents for the seller only.
•SpicyAuctions’ records (written, audio, or digital) are final.
•If any part of these terms is invalid, the rest still apply.
13. Final Reminder
•By registering and bidding, you agree to all terms.
•Once you bid, you own it.
•Inspect items, pay on time, and pick up promptly.
