• Transactional Information: We collect transactional information about your purchases, such as the items you purchased, the date of purchase, and the amount paid.

• We use your personal information to:
  • Process your orders and fulfill your requests.
  • Send you important information about your orders such as including order confirmations and shipping notifications.
  • Respond to your inquiries and customer service requests.
  • Improve our services.
  • We may share your transactional information with third-party service providers who assist us with order processing, such as payment processors and shipping companies.
• We will never sell or share your personal information with a third party that is not directly involved in processing your transactions.

Children's Privacy

The Site is not directed to children under the age of 18. We do not knowingly collect personal information from children under the age of 18. If you are a parent or guardian and you believe that your child has provided us with personal information, please contact us. We will take steps to remove the information.

Before you bid, please read these Terms & Conditions. By registering or placing a bid, you agree to all of the following:

Who Can Bid

• You must be 18 or older to bid.
• You must register to bid.

The Auction Process

1. Registration

• The process of registration results in account creation that provides you with your unique bidder number.
• Registration requires your submission of personal information that may include your name, address, phone, email, and a valid credit card.
• Anything bid under your registered account is your responsibility — keep your account information safe.
• All sales are final – there are no refunds or exchanges.

2. Bidding

• Items may sell with either a reserve or no reserve.
• Shippable items will be marked as shipping available.
• Not all items can be shipped.  Some items are local pickup only. 
• A winning bid is a binding contract to purchase.
• The auctioneer sets increments, controls bidding, and may reject bids.

3. Buyer’s Premium & Tax

• A Buyer’s Premium fee is added to all purchases. 
• The Buyer’s Premium fee covers fees involved in hosting an auction and processing payments.
• The Buyer’s Premium may change for each/any auction.
• The Buyer’s Premium is set at the discretion of the Auctioneer.
• Sales tax (if applicable) is charged on both your bid price and the premium.
• To be eligible for Tax Exempt purchases, bidders Tax Exempt status must be registered with AuctionNinja.  Individual Auctioneers do not control or provide tax exempt purchases.  Tax Exemption must be registered with AuctionNinja BEFORE you bid.
• Some items may not incur sales tax based on state law (ie – coins are often sales tax exempt)

4. Auction Closing

• Closing times are approximate; we may extend or shorten at our discretion.
• Place bids early—don’t wait until the last second on individual items. 
• AuctionNinja may or may not recognize last seconds bids.  A missed bid is not the responsibility of of AuctionNinja or the Auctioneer.
• All times are in Mountain Standard Time (MST).

5. Payment

• Payment is collected at Auction Close
• Accepted payments methods: Credit Card (all major U.S. cards).
• If you win, the card on file may be charged.
• Payment is due at time of Auction Close.
• Failure to pay may result in relisting, fees, or loss of bidding privileges.
• If it goes past a week from the auction you may be charged and forfeited your items.
• If your credit card is declined, a $10 decline fee will be added to your invoice each time the card fails.
• If payment is not made within 24 hours, your items may be placed in storage up to a week until paid.
• After a week your item may forfeited and automatically relisted.
• If items are relisted due to non-payment, you will be charged for the full price of the item plus any fees.
• Auctioneer reserves the right to charge your registered credit card at any time to recover any unpaid balances, fees, or costs owed.
• Unpaid items may also result in suspension or a permanent ban from future auctions.

6. Pickup & Removal

• Local pickup is available during the scheduled dates and times only.
• Bring your own help and equipment. Staff does not load items.
• Any damage during removal is your responsibility.
• Items not picked up on time may be considered abandoned and resold or disposed of.
• To cover labor and overhead, a $1.00 handling fee per lot is added to all lots.  Example: If you win 5 lots, your invoice will include an extra $5.00 (5 × $1.00)

7. Storage Policy

• If you can’t pick up on time, we’ll hold items until the next business day for free.
• After the first day: $5 per item per day storage fee.
• After 7 days, unclaimed items are considered forfeited and become property of SpicyAuctions.com.

8. Shipping (if available/applicable)

• Items/Lots in an auction may or may not be offered for shipping.  Some items may be local pickup only.  Please be aware of shipping status of a lot before you bid on any item.
• Shipping is handled in-house using an email driven process.
• You must email the following shipping information to info@spicyauctions.com after receipt of your Win Bid 
  
  • Invoice Number
  • Email
  • Phone
  • First Name
  • Last Name
  • Address
  • City
  • State
  • Zip
• Shipping is calculated and processed after Auction Close.
• Lots will be combined for a single shipment cost.
• Buyer will be invoiced for shipping after Auction Close and after payment for items has been successfully completed.
• Auctioneer is not responsible for any damage or lost items once items are in the shipper’s hands. We will do everything in our power to help you with an insurance claim if needed.
• Shipping Fees will be applied to cover labor, supplies, overhead and the carrier shipping charges:
  • $1.00 shipping label fee per per box.
  • $1.00 packing fee per lot, capped at $10 per box.
  • Buyer pays carrier postage fee.
  • Shipping Insurance may be available at buyer’s request.  Shipping insurance is paid by buyer.

9. Condition of Items

• Please review all images for any lot prior to bidding.
• The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging.
• Specific items may have a declaration of condition.  This declared condition or value is the opinion of the Auctioneer staff.  Auctioneer staff are not professional graders or valuation experts.  Statements of conditions or values are opinions only.
• If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question.
• By placing a bid, you signify that you have examined the items as fully as you desire or that you have chosen not to examine them.
• Bidding on these items is acceptance of these terms.
• All items are sold “AS-IS, WHERE-IS, WITH ALL FAULTS.”
• No guarantees, warranties, returns, or refunds.

10. Titles & Vehicles

• Titles are transferred between buyer and seller at a notary.
• Auctioneer is not responsible for title transfer issues.

11. Rules & Responsibilities

• You own your items the moment bidding closes.
• No claims once items leave the premises.
• Sales tax applies unless you file a valid exemption before bidding.

12. Legal Notes

• All disputes fall under Colorado law, Boulder County courts.
• Auctioneers act as agents for the seller only.
• Auctioneer records (written, audio, or digital) are final.
• If any part of these terms is invalid, the rest still apply.

13. Final Reminder

• By registering and bidding, you agree to all terms.
• If you win it, you own it.
• Inspect items, pay on time, and pick up promptly.
