Terms and Conditions for Opus Creations

By participating in any auction hosted by Opus Creations (referred to as "we," "our," or "us"), you (the "Bidder," "Buyer," or "Customer") agree to the following Terms and Conditions. These terms govern your participation in the auctions, and it is your responsibility to read them thoroughly before engaging.

1. Eligibility

To participate in an auction, you must be at least 18 years of age and legally capable of entering into contracts. By registering for the auction, you confirm that you meet these eligibility requirements.

2. Registration

To bid, you must register with Opus Creations. The registration process may require you to provide your full legal name, address, phone number, email, and valid payment information.

3. Auction Process

• Bidding: Once registered, you may place bids on items listed in the auction. Bids cannot be withdrawn once placed. All bids are binding and cannot be canceled.

• Auction End: The auction ends at the time specified on the listing. In the event of a technical issue, the auction may be extended at the sole discretion of Opus Creations.

• Winning Bid: The highest bid at the end of the auction for each item constitutes the winning bid. The bidder agrees to pay the winning bid amount, plus applicable taxes, fees, and shipping costs.

4. Payment

• Accepted Payment Methods: We accept Credit/Debit Cards (Visa, MasterCard, Discover, American Express).

• Payment Terms: Payments are due within 24 hours after the auction closes. Late payments may result in forfeiting the item and relisting it for auction.

• High-Value Orders: For orders with a Hammer Price of $1000 or higher, a confirmation email or phone call will be made to confirm that the purchase is not fraudulent.

• High-Value Shipping: For orders with a Hammer Price of $1000 or higher, the order will be shipped via UPS 2nd Day Air Delivery with Adult Signature required.

5. Shipping and Handling

• Shipping Providers: Shipping will be via a major provider such as the U.S. Post Office, FedEx, or UPS.

• Shipping Costs: Winning bidders are responsible for all shipping costs. Shipping fees are listed in the product description for each Lot.

• Jewelry Items: Jewelry items are shipped within 48 business hours after payment is received and cleared.

• Non-Jewelry Items: Non-jewelry items are shipped within 2-3 business days after payment is received and cleared.

• Diamond Jewelry: ALL DIAMOND JEWELRY ITEMS WILL BE SHIPPED. PICK UP IS NOT AVAILABLE.

• Risk of Loss: All items are shipped at the buyer's risk. Once an item is shipped, Opus Creations is not responsible for any damage or loss that occurs during transit.

6. Taxes

• Sales tax will be applied to the total purchase price of the item and any applicable fees, based on the buyer’s shipping address.

• Buyers are responsible for all taxes, customs duties, and other charges that may apply.

7. Item Condition

• Opus Creations makes reasonable efforts to describe and photograph each item accurately. However, all items are sold "AS IS," with no warranties or guarantees.

• All descriptions and photographs are provided for reference only. Opus Creations does not guarantee the accuracy of any item descriptions, and bidders are encouraged to ask questions or request additional details before placing bids.

8. Reserve Price

Some items may have a reserve price, which is the minimum amount that must be met for the item to sell. If the reserve price is not met, the item may not be sold.

9. Auction Fees

• Buyer’s Premium: A buyer’s premium of [Insert percentage, e.g., 10-15%] will be added to the final bid price of each item and is part of the total purchase price.

• Additional Fees: Any additional fees such as handling or shipping charges will be disclosed at the time of the auction.

10. Returns and Refunds

• No Returns: All sales are final, and Opus Creations does not accept returns unless the item is significantly not as described or damaged during shipping.

• Damaged Items: If an item is damaged during shipping, please contact us within 48 hours after the item has been delivered to file a claim and provide photographic evidence of the damage.

11. Dispute Resolution

• In the event of a dispute, both the bidder and Opus Creations agree to attempt resolution through amicable discussions. If necessary, legal disputes may be handled through the courts of the State of Illinois.

12. Limitation of Liability

• Opus Creations is not liable for any indirect, special, incidental, or consequential damages resulting from your participation in the auction, including but not limited to loss of profits, data, or business opportunities.

13. Changes to Terms

Opus Creations reserves the right to modify these Terms and Conditions at any time without notice. The updated Terms will be posted on the auction site, and your continued participation in the auction indicates your acceptance of the revised terms.

14. Governing Law

• These Terms and Conditions shall be governed by the laws of the State of Illinois.
