1. BUYER'S CONTRACT

Please DO NOT bid if you do not intend to purchase and pickup your items as ALL BIDS placed on this website are considered binding contracts. The Buyer is responsible for paying all invoiced amounts due to "Jem Estate Sales". This includes the final hammer price, buyer's premium, and all applicable sales taxes. 

2. BUYER'S PREMIUM

A "Buyer's Premium" of 18% will added to the final invoice and charged to the debit or credit card you have on file with "Jem Estate Sales" along with the hammer price and all applicable sales taxes within 24 hours of auction's end.

3. SALES TAX

All sales are subject to applicable sales tax laws. Tax exempt buyers must provide a state sales tax exemption certificate to "Jem Estate Sales". If you think you qualify for tax exempt status, you must submit your tax ID certificate to AuctionNinja. We are unable to collect and process tax ID certificates.  Your profile name and address must be the same as your resale certificate.

4. ITEM DESCRIPTIONS

All items are sold as-is, where-is. Most of the items listed for auction are used, vintage or antique. Therefore, signs of wear consistent with age should be expected. We do our best to accurately describe all items up for auction but PLEASE review the photos in helping to determine the item's condition.  We try and test Electronics / appliances to make sure they are in working order. The absence of any descriptions or conditions must not be taken to imply that the lot is in perfect condition. Our listings occasionally include props used to display the items, like picture holders, jewelry display pieces & others. Unless explicitly stated, these items are not included with the lot.  Please reach out to us via text or email if you have questions regarding an item's condition. All sales are final. No returns, credits, refunds, or exchanges. Once item(s) leave the premises; Jem Productions is not responsible for condition.

5. PICK-UP

Furniture & Large items, please BRING HELPERS & TOOLS to load! We are physically unable to assist.  Items are “AS-IS” and “WHERE-IS” When you are purchasing furniture or large lots you are responsible to remove ALL items. Any items (ie: mattresses & box springs) left; buyer will be responsible to paying a dump fee. The fee will depend on what item(s) are left as to how much that fee will be. You are agreeing when bidding to remove all the contents of that lot! JEM Estate Sales does not move or store any items. Bring all necessary tools and labor you will need to pick up your items.

We work hard to get our customer's their purchases; but be advised that it is YOUR responsibility to make sure all your purchases are complete! We hold NO responsibility for partially completed orders!  JEM Estate Sales will not responsible for items not picked by the stated time. If you are unable to meet for the specified pick-up time; please contact US before the pickup time window ends. A rescheduled pick-up time can be arranged, with a $10 inconvenience fee imposed. JEM Estate Sales will not be responsible for items that are not picking up during pick-up time. Buyer acknowledges that they agree to pick-up their items when they Bid.

6. SHIPPING

We offer shipping on some items in the auction, and those items have a "Shipping Available" icon on their postings. See "Pickup and shipping details" for additional information about packing charges and shipping fees. If you purchase an item without a "Shipping Available" icon, please contact us prior to bidding to arrange shipping options.  Please know JEM Estate Sales will not be responsible if items get damaged during shipping. There is a handling fee of $10 per box. Notice, per box, not per item or per lot. If it fits into one box it will be $10.  Shipping Invoice for larger Items, will be sent separate from Auction invoice, and must be paid prior to items being shipped.

7. PAYMENTS   
8. We will accept cash, credit, debit cards. IF you want to pay cash, please let US know right away so that your credit card does not get charged. All buyers who do not pick up their items will have credit cards run at the end of pickup time. Credit cards are charged 3% processing fees!
