This situation involved a first-time bidder who believed that we removed a coat from the auction while she was actively bidding and then re-listed it afterward. For clarity, the auction platform does not function that way. Sellers cannot secretly remove an item during active bidding and reinsert it without a full system record. All bidding activity, timestamps, and lot status changes are tracked by the platform itself.rnrnWe explained this to the bidder at the time. Unfortunately, the accusation of manipulation was unfounded and escalated unnecessarily.rnrnWe take transparency very seriously and operate strictly within the platform’s rules. I know I am at risk when I bid on an untested pair of AR3a speakers. I spent over $500 including fee and tax. Turns out both speakers were completely dead. First of all, water damaged (no picture shown, or deliberately not shown), both woofers need to be refoamed (which I had expected, so not a big deal, even though they did not showing pictures of the woofers), both mid ranges are bad (not repaireable), both woofers are dead (not repairable), all 4 l-pads need to be replaced. I would definitely have not paid that much had I known from pictures that this has water damage and refoam needed, which is a good sign that the woofers are bad. This is by far the worst purchase I have made on auctionninja.

Any issues related to drivers, midranges, woofers, or L-pads fall within the known risk of purchasing an untested item and should be factored into bidding decisions.rnrnWe would also like to address the statement suggesting that water damage was “deliberately not shown.” The speakers were photographed thoroughly from multiple exterior angles, and there was no visible water damage at the time of listing. We do not conceal defects, nor do we disassemble items unless specifically stated. There was no observable indication of internal water exposure during intake or photography.rnrnVintage audio equipment, especially when sold untested, often requires restoration. That risk is inherent in the listing description and reflected in the bidding process.rnrnWe stand by the accuracy and transparency of our listing.

This auctioneers listings and pictures are created to deceive bidders, and then they rely on disclaimers to cover for their dishonest business practices. Buyer beware they are not reputable!

You arrived to pick up the bench you won, then realized it would not fit in your compact vehicle due to your lack of transportation planning. Only after that did you claim the item was “damaged,” even though the bench is over 100 years old and all wear was clearly shown in the photos exactly as we do for every item.rnrnDespite the claim being unfounded, we still issued you a full refund to make things right. Excellent haul at this sale - lightly worn brand name shoes, a vintage brooks brothers throw that sells for 10 times more on eBay and other quality items. Pictures did not do these justice. Everything was better than expected!

Hold Harmless

By placing a bid and agreeing to pick up the purchased items, the Bidder and any individuals or entities associated with the Bidder agree to save, defend, keep harmless, and indemnify the Company, as well as its agents, clients, volunteers, board members, employees, and partners, from any and all claims, losses, damages, injuries, costs (including court costs and attorney's fees), charges, liabilities, or exposures arising out of or connected to the pick-up of items at the premises designated by the Company. This includes, but is not limited to, any injuries or damages sustained by the Bidder or their associates while on the premises.

Mandatory Arbitration

By placing any bid, you agree that if a dispute arises related to this auction that exceeds $10,000, including the bidding process, item pickup, or any other aspect of participation, and if the parties are unable to resolve the dispute directly, the parties agree to first attempt resolution through mediation administered by the American Arbitration Association (AAA) under its Commercial Mediation Procedures. If mediation does not resolve the issue, any unresolved controversy or claim arising out of or relating to this auction shall be resolved through arbitration administered by the AAA in accordance with its Commercial Arbitration Rules. Claims under this dollar amount may be resolved in small claims court. Judgment on the arbitrator's award may be entered exclusively in the courts of the State of New York or the federal courts located in New York, provided they have jurisdiction. The arbitrator’s ruling is conclusive and not subject to appeal. Neither party may pursue litigation except as provided herein, with small claims disputes handled in small claims court and arbitration rulings enforceable in federal or applicable state courts.

Class Action Waiver

By placing any bid, you agree that any claim must be made individually, and not as a plaintiff or class member in any alleged class, collective, representative, multiple plaintiffs, or similar process (“Class Action”). The parties explicitly forgo their respective rights to bring a class action in any forum. The arbitrator is not authorized to consolidate or aggregate comparable claims, to undertake class actions, or to grant an award to a person or entity that is not a party to the arbitration. Any allegation that this Class Action Waiver is unenforceable, unconscionable, invalid, or voidable in whole or in part may be resolved solely by a court of competent jurisdiction, not by an arbitrator. The parties acknowledge that they would have been entitled to litigate in court, to have their matter decided by a judge or jury, and to participate in a class or representative action. However, the parties recognize and agree that any disputes should be resolved individually, through arbitration based on the section above.
