ESTATE SQUAD LLC Terms and Conditions
These terms and conditions (the “Estate Squad LLC Terms and Conditions”) govern your use and access of the Site and the Services, your purchase of goods on the Site, and your conduct on the Site. You may use the Site only in accordance with and subject to these Terms of Use. Once you complete and submit your registration, you acknowledge and agree that you have opted in to receive email communications from us. As a condition of maintaining membership on this Site, you must consent to receive such communications from us and, where applicable, from our partners, affiliates, or other entities owned, operated, or managed by our officers or owners. You must also authorize ESTATE SQUAD LLC to charge the credit or debit card you have entered on this site for the hammer price of an item which you were the high bidder plus the buyer's premium and all applicable sales tax. Your card will be charged within 24 hours of auction end. Failure to keep valid credit card information on file will result in your use of the site being terminated.
To initiate your ability to bid with ESTATE SQUAD LLC, an initial $1.00 pre-authorization transaction will appear on your statement. This pending transaction will not settle and will drop off after 5–7 business days (American Express & Discover may take longer).
You certify that you are an authorized user of this credit card and that you will not dispute the purchase payments with your credit card company provided the transactions correspond to the terms indicated in this authorization outline.
Please read these Estate Squad LLC Terms and Conditions prior to using the Site and the Services. ESTATE SQUAD LLC provides you with access to and use of the Site and the Services subject to your compliance with these Provenance Auctions Terms and Conditions and the Site’s Terms of Use, available here, and Privacy Policy, available here. Your use of the Site and/or the Services constitutes your express agreement to these Estate Squad LLC Terms and Conditions. If you do not agree to these Estate Squad LLC Terms and Conditions or if you are not legally competent to agree to them, then you may not access or use the Site or the Services. These Provenance Auctions Terms and Conditions do not alter the terms or conditions of any other agreement you may have with us.
1. Eligibility to Use the Site and the Services
While using the Site and/or the Services, you agree that you will not:
• Use the Site or Services if you are not able to form a legally binding contract or if you are under the age of eighteen (18) years old;
• Use the Services if you have been previously suspended or removed from the Site or engaged in any activity that could result in suspension or removal from the Site;
• Manipulate the price of any item without the intent to purchase;
• Circumvent or manipulate our fee structure, the billing process, any fees owed to ESTATE SQUAD LLC, or any technical measures we use to provide the Services;
• Fail to deliver payment for items purchased by you and associated fees;
• Transfer or share your account and bidder number with another party without our consent;
• Create accounts that misrepresent your identity or use the personal information of others;
• Use any automated means to access the Services;
• Access data not intended for you or log into a server or account which you are not authorized to access;
• Use the Site in any manner that would interfere with, disrupt or inhibit other users from fully enjoying the Site or that could damage, disable or impair the functionality of the Site;
• Conduct fraudulent activities; or
• Bid on any items that may be sold only to persons at least twenty-one (21) years old if you are under the age of twenty-one (21) years old.
2. Sales Item Descriptions
All items are sold “as is” and you are aware that, unless otherwise stated, the items sold on the Site are not new nor in perfect condition, may require touch-up or repairs prior to use and the available information about these items may be limited. ESTATE SQUAD LLC will not list every flaw associated with each item as these are to be expected. In the case of obvious faults (chips, cracks, significant damage, etc.) ESTATE SQUAD LLC does its best to list the fault within the description. ESTATE SQUAD LLC will provide descriptions based on its assessment of an item. However, you should not assume that our assessment of condition will be the same as your assessment. It is your responsibility to read and review all descriptions and images of an item before bidding, and you acknowledge that in posting such descriptions, ESTATE SQUAD LLC relies on information provided by the seller. ESTATE SQUAD LLC AND SELLERS MAKE NO, AND EXPRESSLY DISCLAIM ANY, GUARANTEE, WARRANTY OR REPRESENTATION, expressed or implied, including condition, merchantability, quality, rarity, importance, fitness for a particular purpose, or otherwise.
Sales Format
Unless otherwise explicitly stated by ESTATE SQUAD LLC, auctions follow standard guidelines including highest bidder wins, no reserve (unless stated), and no withdrawal after bidding begins. ESTATE SQUAD LLC reserves the right to withdraw items or amend content at any time.
3. Bidding Buyer’s Contract
Your winning bid is an irrevocable contract. You are responsible for paying all amounts due to ESTATE SQUAD LLC.
By providing payment information, you authorize ESTATE SQUAD LLC to charge your card for all applicable costs. ESTATE SQUAD LLC may cancel bids or suspend accounts lacking valid payment details.
4. Payment
If you fail to pick up items, ESTATE SQUAD LLC may charge your payment method.
Buyer’s Premium: 20–25% added and charged by ESTATE SQUAD LLC.
Sales Tax: Applied per law; exemptions must be submitted to ESTATE SQUAD LLC.
Failure to Pay: Items may be forfeited and resold or donated by ESTATE SQUAD LLC, and collection actions may be taken.
5. Fulfillment
Pickup, alternate pickup, and shipping options may be offered by ESTATE SQUAD LLC.
Failure to Pickup: Items may be considered abandoned and ownership transferred to ESTATE SQUAD LLC, which may resell, dispose, or donate them.
Liquidated Damages
Damages owed to ESTATE SQUAD LLC are considered compensation, not penalties.
6. Returns
All sales are final. No returns, credits, or exchanges through ESTATE SQUAD LLC.
7. Indemnity
You agree to indemnify ESTATE SQUAD LLC and its affiliates from claims arising from your use of the Services.
8. Limitation of Liability
ESTATE SQUAD LLC is not liable for indirect or consequential damages. Total liability is limited to payments made to ESTATE SQUAD LLC in the prior two months.
9. Miscellaneous
ESTATE SQUAD LLC may modify these terms at any time.
Notices, waiver, remedies, severability, force majeure, and assignment provisions all apply to ESTATE SQUAD LLC.
Governing Law: Connecticut law applies; disputes resolved in Fairfield County courts.
Entire Agreement: These terms represent the full agreement with ESTATE SQUAD LLC.
